The next court date in the ongoing Caddo Confederate Monument saga has been reset to a later date.
In November, the Shreveport chapter of the United Daughters of the Confederacy (UDC) filed a petition requesting for a temporary restraining order against Caddo Parish and the commission.
The request seeks to prevent the commission from using Article 493 of the Civil Code to claim ownership of the monument located outside the Caddo Parish Courthouse.
A court date was initially set for Jan. 13, 2020, but was reset for Feb. 20, 2020, at 9:30 a.m., per a court document filed last week.
The UDC argues in the court document that Article 493, in its history, was used for the right to claim and remove oil well facilities that were left on properties because of unsuccessful oil and gas well.
“In over 100 years, the statute has never been used in Caddo Parish or elsewhere as a device to claim ownership of valuable personal property such as attempted here,” the document read, and referring to the confederate monument.
“Throughout the legal proceedings, involving the parties, the Commission never once alluded to a article 493 or claimed any rights thereunder.”
In August, a letter was sent to the Shreveport chapter of UDC demanding the group to remove the monument within a 90-day period. The 90-day period expired on Nov. 26.
